KP Govt Decides To Charge PDM Leaders with ‘Seditious’ Remarks

The PTI-led government in Khyber-Pakhtunkhwa (K-P) resolved to book PDM lawmakers for making “hateful and seditious statements” against the government’s institutions.

A request for a first information report (FIR), a copy of which is available with The Express Tribune, was made at the Sharqi police station by section 196 of the Code of Criminal Procedure (CrPC), which deals with prosecution for crimes against the state, and sections 153-A, which deals with inciting hostility between various groups, 108-A, which deals with committing crimes outside of Pakistan, and section 505 of the Pakistan Penal Code.

Nawaz Sharif, Shehbaz Sharif, Maryam Nawaz, Khawaja Saad Rafique, Rana Sanaullah, Atta Tarar, Ayaz Sadiq, Pervaiz Rashid, and Maulana Fazlur Rehman, the leader of the JUI-F, were all named in the application. The complainant, a lawyer by profession, said that PDM officials had in the past made derogatory statements about the nation to undermine its institutions and sovereignty.

He claimed that after being widely shared on social media, the “provocative” remarks made against the military and courts were seen by a sizable number of individuals all over the world. He went on to say that, like many other Americans, he was extremely affected by the words that, in his opinion, were made at the request of a foreign nation. According to Section 196 of the CrPC, Dera Ismail Khan Additional Assistant Commissioner Muneer Ahmad was authorized to file the cases in response to the complaint of the former federal minister and PTI leader Ali Amin Gandapur.

Sources disclosed that the K-P government had been building a legal case against the PDM leaders before the current occurrence. Following approval by the K-P cabinet, the administration department of the provincial government issued a notification on August 19. The provincial administration decided against making its choice public, though.

The notification reads that in the exercise of powers conferred by Section 196 of the Code of Criminal Procedure, 1989 and by the cabinet’s decision dated August 18, 2022, the government of Khyber-Pakhtunkhwa is pleased to authorize Muneer Ahmad, additional assistant commissioner, DI Khan to accept written complaints from Ali Ameen Gandapur or any other interested party and require local police to lodge FIR(s) under sections 108-A, with effect from August 18, 2022, he is authorized to sanction and pursue such cases under sections 153-A and 505 of the Pakistan Penal Code, 1860, read with any other applicable enabling legislation.

Khan, 19 Other Top PTI Leaders booked

The K-P administration, where the PTI is in charge, has decided to bring charges against PDM leaders for their “hateful utterances,” Special Assistant to the K-P Chief Minister Barrister Mohammad Ali Saif said earlier in the day. The action follows Imran Khan, the former prime minister, being detained on Sunday under the anti-terrorism statute.
