WATCH: PTI shares Judge’s ‘Controversial Facebook Posts’ across their social media Pages

The “controversial” Facebook posts of the judge overseeing the Toshakhana case were submitted to the Federal Investigation Agency (FIA) by the Islamabad High Court (IHC).

Meanwhile, a lower court granted PTI president Imran Khan a once-off exemption from appearing in the Toshakhana criminal case.

The Additional District and Sessions Judge (ADSJ) Humayun Dilawar’s court was the subject of Mr. Khan’s petitions, which he filed to have his case transferred there. Under Section 342 of the Criminal Procedure Code, which allows the judge to examine an accused person before the trial is over, Mr. Khan’s trial is at its conclusion. As a result, the court has already summoned him to provide a statement.

 

Mr. Khan requested several reliefs in the Toshakhana case, including the transfer of the case and the summoning of records from the Election Commission of Pakistan (ECP). He was also disputing the viability of the ECP’s complaint that he had omitted information about state gifts from his asset declarations.

The petition filed by the PTI chairman challenging the complaint’s maintainability, according to Justice Farooq, is actually “the second round of litigation on inter alia subject of limitation and authority of the person filing the complaint on behalf of the Election Commission of Pakistan, as earlier this Court [IHC] had referred to the learned trial court for a decision afresh.” Also unsuccessfully, Mr. Khan appealed the case to the Supreme Court.

 

Mr. Khan has argued that the judge hearing the Toshakhana case is biased, and in support of this argument, the judge has been provided specific posts from Mr. Khan’s Facebook account, which were also shown to the chief justice of the IHC. Mr. Khan has also argued that the case should be transferred to a different court. The trial court judge dismissed the posts after being informed. The registrar’s office was instructed by Justice Farooq to “remit the issue of the authenticity of the posts to the Cyber Crime Wing of the Federal Investigation Agency, Islamabad, with the directive to submit the report positively before the next date of hearing.”

A further hearing was postponed until the following week after the court requested assistance from the ECP. In the meantime, Mr. Khan’s appeal asking for the transfer of his bail applications in the cases brought against him as a result of the violent protests on May 9 was also rejected by IHC Chief Justice Aamer Farooq. Observing that the attorney was unable to provide a convincing justification for such a request, he refused the request for the bail applications to be transferred.
