Harvard Law Alumni Association Congratulates Judge Ayesha Malik

Harvard Law Alumni Association has congratulated Supreme Court Judge Ayesha Malik for becoming the first female judge to reach the apex court of Pakistan.

Ayesha Malik LL.M. ’99 has become the first woman to serve as a justice of Pakistan’s Supreme Court in the country’s 75-year history, in an event that has been described as historic, energising, and divisive.

Malik was a judge on the Lahore High Court in Pakistan’s Punjab area for a decade before being appointed to the Supreme Court. She has served on the board of the Punjab Judicial Academy and as the chair of a nationwide review committee focused on women in the judiciary.

She also practised corporate law and litigation at two organizations before entering the judiciary, as well as teaching banking and mercantile law at the University of the Punjab and the College of Accounting & Management Sciences in Karachi.

Malik sat on the Green Bench, which deals with environmental disputes, and decided on the implementation of international arbitration in Pakistan as a High Court judge. She gave a crucial judgement forbidding the use of virginity tests in rape cases last year, before being nominated for the Supreme Court, saying that the practise “offends the dignity of the female victim” and discriminates on the basis of gender.

Following Malik’s decision, the Punjab and Sindh governments issued orders prohibiting the use of virginity tests in sexual assault cases involving women, and the Supreme Court of Pakistan followed suit in a similar case, setting a precedent that was followed by all of Pakistan’s high courts.
